| Sumario: | The concept of family has undergone multiple transformations in our country
throughout history, which is why this research aims to establish through a normative -
jurisprudential study if in Colombia there is a legal concept about the family, where they
take into account the constitutional foundations in the recognition of new ways of
establishing the family; every time, that the Political Constitution of 1991 recognizes as
a fundamental right to have a family and attaches great importance to it within the
structure and organization of the Colombian State as it is considered as an essential
nucleus of society.
Therefore, the constitutional foundations are taken into account in the recognition
of new forms of constitution of the family and the analysis of the legal and jurisprudential
order concerning the family, its rights and duties is necessary; addressing the theme of
family dogmatic concepts, background and historical evolution of the transformation of
the constitutional concept of the family and its obligations, the way of establishing the
family through the marriage bond, personal and property obligations established in this
link, the formation of the marital union in fact and same-sex couples. |
