This paper examines the legal, political, and institutional obstacles that hinder the investigation and prosecution of this crime, as well as the limitations in the use of forensic technologies and interinstitutional coordination. It argues for the need of legal reforms aimed at ensuring the non-applicability of statutory limitations, enhancing specialized investigation, improving coordination between ordinary and transitional justice, and strengthening protection for victims and witnesses. Overcoming these shortcomings is essential to guarantee the rights to truth, justice, and comprehensive reparation, while contributing to historical memory and peacebuilding in Colombia. |

La desaparición forzada en Colombia constituye uno de los crímenes de lesa humanidad más graves y persistentes, caracterizado por altos índices de impunidad pese a la existencia de un marco jurídico robusto a nivel nacional e internacional. El presente trabajo analiza los obstáculos jurídicos, políticos e institucionales que dificultan la investigación y sanción de este delito, así como las limitaciones en el uso de tecnologías forenses y en la coordinación interinstitucional. Se propone la necesidad de reformas legales que garanticen la imprescriptibilidad del delito, la especialización investigativa, la articulación entre justicia ordinaria y transicional, y un fortalecimiento real de la protección a víctimas y testigos. La superación de estas falencias resulta esencial para garantizar los derechos a la verdad, la justicia y la reparación integral, contribuyendo a la memoria histórica y a la construcción de la paz en el país.
