This is of superlative importance for criminal dogmatic and for the theory of crime, especially when trying to determine whether a subject acts with intent or with recklessness at the time of performing an action that produces a typical result, which makes it possible to consider the idea of using neuroscience as expert evidence for criminal proceedings, closely following the requirements established in article 422 of Law 906 of 2004.

Los importantes avances que ha tenido la neurociencia durante las últimas décadas han conllevado a que se replanteen teorías en distintos campos del saber, pues esto ha permitido que se creen tecnologías sofisticadas que permitan obtener imágenes no solo del cerebro, sino también del funcionamiento neuronal en el sistema nervioso central, lo cual hace posible establecer si una persona actúa con libre albedrío o no, o si esa persona es realmente consciente de los actos que realiza en su vida cotidiana. Esto resulta de importancia superlativa para la dogmática penal y para la teoría del delito, sobre todo cuando se intenta determinar si un sujeto actúa con intención o con imprudencia al momento de realizar una acción que produzca un resultado típico, lo cual hace posible plantearse la idea de utilizar la neurociencia como prueba pericial para los procesos penales, siguiendo de cerca los requisitos establecidos en el artículo 422 de la Ley 906 de 2004.
