The sources in the qualitative area are secondary sources brought in from academic texts and jurisprudence of the Constitutional Court that make up the theoretical part of the research. It is evident from the study carried out that the principle of human dignity is a fundamental pillar in the evolution towards the fundamental nature of the right to health. To conclude the above, it is appropriate to say that in practice the legal, jurisprudential and doctrinal scopes are short, before seeing a 29-year struggle, since the emergence of the 1991 Constitution, reflected on a material level. |

Esta investigación aborda temas intrínsecos al sistema de salud colombiano, respecto de los derechos que se ven inmiscuidos en la prestación de este servicio, el cual, ha adquirido un importante lugar como derecho fundamental, desde el pronunciamiento hito de la Corte Constitucional, en la Sentencia T-760 del 2008, con una herramienta fundamental dada por la Constitución de 1991, la acción de tutela. Las fuentes en el área cualitativa, son fuentes secundarias traídas desde los textos académicos y jurisprudencia de la Corte Constitucional que conforman la parte teórica de la investigación. Se evidencia del estudio realizado, que el principio de la dignidad humana resulta un pilar fundamental en la evolución hacia el carácter fundamental del derecho a la salud.
