This topic takes on special importance when observing the social impact generated by the exercise of prostitution, both in those who participate directly in its activity, and in society in general. The analysis will be carried out based on the examination of the legal, doctrinal and jurisprudential framework; Scenarios through which the recognition and protection of prostitution through the law has been sought. Finally, based on the investigative work, it is recognized that the Colombian legal system is far from having a defined position on the subject. However, the existence of a guaranteeing vision of the rights of those who exercise prostitution is highlighted, as they are recognized as subjects in a special situation of vulnerability, the above, based on human dignity and freedom. |

Alrededor de la prostitución, en Colombia se ha desarrollado un debate enfocado en la concretización de la posición del ordenamiento jurídico frente a su legitimidad y regulación en relación con la dicotomía planteada por posturas contrapuestas como lo serán la regulación, implicando el reconocimiento constitucional y en materia de derechos laborales; su abolición, al considerarse contraria a la dignidad humana; y su prohibición. Este tema toma una especial importancia al observar el impacto social que genera el ejercicio de la prostitución, tanto en aquellos que participan directamente de su actividad, como en la sociedad en general. El análisis se realizará partiendo del examen del marco legal, doctrinal y jurisprudencial; Escenarios a través de los cuales se ha buscado el reconocimiento y protección de la prostitución a través del Derecho. Finalmente, a partir de la labor investigativa se reconoce que el ordenamiento jurídico colombiano dista de tener una posición definida frente al tema. No obstante, se resalta la existencia de una visión garantista de los derechos de quienes ejercen la prostitución, en tanto se les reconoce como sujetos en una situación especial de vulnerabilidad, lo anterior, teniendo como fundamento la dignidad humana y la libertad.
