En Colombia, los avances en la responsabilidad civil dentro de las relaciones familiares han sido lentos. Han sido las altas cortes quienes se han preocupado para que en temas de protección a la mujer se resarzan los daños que se les causen y son generadores del rompimiento matrimonial y de la unión marital de hecho. Los remedios que se han propuesto van desde la solicitud de un incidente de reparación integral conforme lo estableció la sentencia SU 080 de 2020 para el matrimonio, extensivo para la unión marital de hecho por la sentencia SC 5039 de 2021, sin desconocer que, para el divorcio, desde la presentación de la demanda se puede hacer el pedimento de perjuicios para que el juez de familia se pronuncie en la sentencia, tal como lo indicó a sentencia C- 111 de 2022.
