Summary:In accordance with the requirement of joint responsibility between the genetic and the legal in he right of filiation, in cases of surrogacy by in vitro fertilization, the woman who contributed her genetic material and does not carry out the delivery, but has the procreation will and the reproductive self-determination, can seek to legitimize her motherhood in accordance with the provisions of article 335 of the Colombian Civil Code when the woman who lent her womb does not want to effectively deliver the baby born from this practice.
