Thus, although not fully regulated, the best interests of children and young persons and the fundamental right to have a family and not be separated from it, have guided analyses of the implementation of joint custody in various cases, thus ensuring the rights and interests of children and young persons Los retos de la implementación de la custodia compartida en los ordenamientos jurídicos de España, Chile y Puerto Rico, permiten evidenciar los posibles problemas que supone su implementación en el ordenamiento jurídico Colombiano, sin embargo, los desafíos hallados en otras legislaciones han sido solventados jurisprudencialmente por la Corte Suprema de Justicia y por la Corte Constitucional en Colombia. De manera que, a pesar de no estar integralmente regulado, el interés superior de los niñas, niños y adolescentes (en adelante NNA) y el derecho fundamental a tener una familia y no ser separados de ella han guiado los análisis de la implementación de la custodia compartida en diversos casos, logrando garantizar los derechos e intereses de los NNA.
