Con el presente proyecto para trabajo de grado, se pretende analizar la providencia emitida por el Juzgado Segundo Penal del Circuito De Garzón - Huila, mediante la cual condena al señor Davinson Stiven Erazo Sánchez por el delito de feminicidio agravado tras haber ocasionado la muerte de Luis Ángel Ramos Claros, quien hacía parte de las personas sexualmente diversas LGTBIQ+ y que era conocido en la comunidad por el nombre de “Anyela”. Por lo anterior, se abordará el alcance que tiene la Ley 1761 de 2015 “Rosa Elvira Cely” acerca del delito de Feminicidio frente a las personas Transgénero, toda vez que el encuadramiento de la conducta frente a la identidad de género en la providencia objeto de análisis, generó un impacto relevante en nuestra sociedad y en los derechos que buscan las personas sexualmente diversas LGTBIQ+ en Colombia, es por esto que, profundizaremos en: ¿por qué en esta investigación se constituyó el delito de feminicidio y no el de homicidio en una persona que como Anyela era legalmente de género masculino, pero cuya identidad siempre se arraigó al género femenino?.
