The commercialization activity is carried out jointly with the distribution activity, for this reason, in parallel, the legislation creates regulations to give guarantees in energy measurement, creating a measurement code which is born as an annex (Sheet 133) of CREG Resolution 025 of 1995 (Networks Code), reaching its last update under CREG Resolution 038 of 2014. The latter establishes all the characteristics, conditions, requirements, operation and maintenance that an energy measurement system must meet, as well as defines, among others things, the normalization times of a commercial border and the procedures for collecting, storing and reporting energy consumption to the Administrator of the Commercial Exchange System-ASIC.
In the present project, the technical and financial impact generated from the entry into force of CREG Resolution 038 of 2014 will be analyzed in the first instance to the marketer who is the one who, before the ASIC, must directly face the guarantee that the code is Complies, in this case for practical purposes an Energy Trading Company will be taken and in the second instance the impact generated to the end user. The different phases of the process will provide evidence of the action plans that were taken to be able to strictly comply with the regulations and with the latter, an attempt will be made to break down the repercussions generated in the process of audits carried out to verify compliance with the regulations. |

En Colombia, conforme a lo dispuesto en la Ley 142 de 1994, algunos usuarios de energía eléctrica pueden elegir libremente al prestador del servicio de energía. La actividad de comercialización está definida como la compra de energía en mercado mayorista y venta con destino a otros agentes o a usuarios finales. La actividad de comercialización se ejerce mancomunadamente con la actividad de distribución, por esta razón en paralelo la legislación crea normatividad para dar garantías en la medición de la energía creando un código de medida el cual nace como anexo (Hoja 133) de la Resolución CREG 025 de 1995 (Código de Redes), llegando a su última actualización bajo la Resolución CREG 038 del 2014. Este último establece todas las características, condiciones, requisitos, operatividad y mantenimiento que debe cumplir un sistema de medición de energía, así como define entre otras cosas, los tiempos de normalización de una frontera comercial y los procedimientos de recolección, almacenamiento y reporte de los consumos de energía al Administrador del Sistema de Intercambios Comerciales-ASIC. En el presente proyecto, se analizará el impacto técnico y financiero generado a partir de la entrada en vigor de la Resolución CREG 038 del 2014 en primera instancia al comercializador que es quien ante el ASIC debe hacer frente directo a la garantía de que el código se cumpla, en este caso para efectos prácticos se tomará a una Empresa Comercializadora de Energía y en segunda instancia el impacto generado al usuario final. Las distintas fases del proceso darán evidencia de los planes de acción que se tomaron para poder dar estricto cumplimiento a la normatividad y con esto último se buscará llegar al desglose de las repercusiones generadas en el proceso de auditorías realizadas para la verificación del cumplimiento de la regulación.
